The Truth Comes Out

Since September of 2009, Herb Thomas has told me that "the family" does not want me around my Grandmother, and that "the family" told him this and that "the family" told him that.  Well, over the last few days I have learned that "the family" Mr. Herb Thomas referred to was one person.  Thomas Charles DeMartini.  The one and only.  The grandson that was never a part of my Grandmother's life.  The same Thomas Charles DeMartini that could never be bothered with my Grandmother and Grandfather.  The one that has shut my Uncle out of my Grandmother's life for the past 18 months.  The disloyal, greedy brother that up until 18 months ago I truly believed was the one person I could trust.  I cannot imagine a hurt more painful than the one he has inflicted on my family.  The disloyalty, lies and betrayal are shocking.  I NEVER imagined he could hurt me like this.

But this blog entry is not about my greedy, selfish brother.  It is about the conservator that  my Uncle and I agreed to have appointed because we were told he was our ally and friend.  His attorney, Elvira Orly, told me that he would be our savior.  He would be the one that would neutralize Elizabeth Adler and Larry Siracusa.

Surprise, surprise, surprise.  When Herb Thomas was appointed in September of 2009 as Conservator of the Person, Larry Siracusa represented Mr. Thomas in other conservator cases.  Herbert and Elizabeth were co-conservators on other cases.  Either Ms. Orly is a convincing liar or she is clueless.  Herb Thomas never intended to be our ally.  He failed.  He has not done his job.  He doesn't care about what is in the best interest of my Grandmother.  If he did, there is NO way he would have placed her in this nursing home to die.

And, that "family" that Mr. Herb Thomas always referred to....they don't exist!  Not one person showed up today to see Noni!

Siracusa Refuses to Return My Personal Property

You know, I was thinking earlier that I could easily work on this Blog full time and still not be able to write about all the outrageous things that have happened at the hands of Lawrence Siracusa and his merry band of thieves.

I have just enough time to write one Blog post right now and gave some thought to what would be an interesting topic to talk about.  This is what came to mind.

Many of my personal belongings are still at my Grandmother's house.  Clothes, furniture, personal items, home decor, linens, paperwork, dishes, china, glasses, STUFF!  These are all items that I brought with me when I moved to San Francisco to care for my Grandmother at the request of my brother and uncle.

I can EVEN prove that these are my property.  I have receipts and other documentation proving that the items were purchased by me with my money before I moved to my Grandmother's house.

YOU WILL NEVER guess what is happening.  Lawrence "Larry" Siracusa, the one that just flat out lies to the Judge, will not allow me to pick-up my property!!

I don't know why I am surprised!

He is responsible for over $600,000 in expenses over a 12 month period that are being charged to my Grandmother's Trust!

He is responsible for the fact that my Grandmother is being forced to die in a nursing home.  Years ago she made me promise I would never let this happen.  I dispise him for what he has done to my Grandmother.

He is responsible for filing dozens of documents with the court that are full of lies and exaggerations...pure fiction.  He then has his client sign the pack of lies and perjure herself.

He is the reason that my Uncle Paul and I have been excluded from my Grandmother's life for the past 18 months.  He is the reason my children have had only limited access to their Great Grandmother.

He is the reason that a second case was filed against me after the exact same case had been dismissed via mediation 6 weeks before.  I even have an email that he sent to my attorney working out a settlement to stop the litigation costs that is dated PRIOR to the Mediation.  The text of the email is included in an earlier Post.

I spoke with a social worker today who told me I should just get over my anger because I am not the only one this is happening to.  "It is happening EVERYWHERE."  Doesn't she have an obligation to report the cases she comes across or at least make an attempt to do what is right?  Never mind!  She is probably on Larry's payroll! 

The list goes on and on, and I am not exaggerating.  I could fill a 3 inch binder, full of single spaced pages that include examples of his outrageous behavior, false accusations, innacurate court filings, on the record lies, violations of the Code of Ethics for attorneys (if there is such a thing!), his total disregard for not only California law but California Probate Code as well as the Rules of the California Superior Court and San Francisco Superior Court...I cannot think of a word that accurately discribes his actions.

NOW, Mr. Siracusa is refusing to give me MY personal property eventhough proof of purchase has been provided to him!

What else has Larry done?  I have a list of topics ready to share.  Check in again tomorrow!

"ONE HUNDRED BILLION DOLLARS!"

Well, Herb Thomas, really out did himself this time.  Below is a copy of an email I sent to him early this morning.

 

Mr. Thomas,

There were NO family members there today.  Not one, and it was her birthday.   I left at 7:10pm.

Are you saying I cannot go to the nursing home tomorrow because a family member just might happen to show up?  Sorry Herb, I am going to see my Grandmother tomorrow if she is still alive.

You have overstepped your boundaries for the last time.  You have believed the wrong people and made decisions that have adversely effected me and my relationship with my Grandmother.   You have been unfair and have made very poor decisions.  Time and time again you have attempted to intimidate me and embarrass me. You don't know me.  You have no clue about the bond between my Grandmother and I.  Too bad for you.  No judge or jury would ever agree with the way you have treated me especially when the truth comes out.  You have had absolutely no valid reason or any factual basis to do what you have done to both me and my Grandmother.

You have kept me from seeing my Grandmother based on the petty gossip of people that never even visited my Grandmother prior to her illness. The fact that you are trying to keep me from seeing my Grandmother when she is dying is probably one of the most cruel and hurtful things I have ever heard of.

I am going to the nursing home tomorrow and will leave the room if a family member happens to stop by.  Believe me, I want nothing to do with them either.

This email was in response to Mr. Herb Adler's attempt to keep me from seeing my Grandmother.  They took her stomach tube out yesterday, and it is just a matter of time now.  I did not want her to die alone and he actually contacted the nursing home and tried to limit my time with her.

I am at the nursing home now and am not leaving until she does!

Fuck you, Herb Thomas!  Someone told me it was okay to say that.

I am so sad to learn that people like him walk this earth!

Today's Hearing Part 2

This one was hard for even me to believe.  Thought I had heard and seen everything with these conservators and attorneys.

My Uncle does not want them to sell our family home.  He has offered to buy the house at market price.  Larry Siracusa wants him to bid on it!  He is going to inherit it once we prove that the changes made to my Grandmother's Trust were done when she did not have the capacity to do so.  However, this arrogant attorney wants my uncle to bid on it with everyone else!  Once again, my Uncle has agreed to pay fair market value!

That Larry.  What a guy!                                                        What next?

Status of Today's Hearing

The attorneys and conservators involved in my Grandmother's case are truly unbelievable!  Not only did they file a petition to get permission to sell my Grandmother's house on her birthday, they sit in there chairs with straight faces and blatantly lie to the Judge.  It is just amazing!

No decision was made today.  It was put off for another two weeks.

Up until today, they have not mentioned my Grandmother one time during any of the proceedings.  Today butter could melt!  They are so concerned about my Grandmother.  Bruce Feder went to the hospital on Monday and held my Grandmother's hand.  It was disgusting!  Look up HYPOCRITE in the dictionary and you will find Bruce Feder, Elizabeth Adler and Larry Siracusa!

In reality, they were backpedaling and covering their behinds BIG TIME.  You see they really blew it.  Probate Code, California Legislation, the San Francisco Superior Court and the California Supreme Court are very clear with regard to conservatee's rights relating to their place of residence.

These liars and thieves moved my Grandmother into that nursing home and broke the law, violated probate code and the rules of the Superior Court.  They had no right to do so without proving (beforehand) that her house was not the best place for her.  It is called preponderance of evidence.

She has been in that awful place since November and today they were trying to convince the Judge that her home was not appropriate.

Larry Siracusa, the biggest liar of them all, actually said that it would cost $20,000 per month for my Grandmother to be brought home.

I did a cost analysis...used to work in human resources and know all about wages, taxes, etc.  Priced out a hospital bed, food, adult diapers, etc.  The cost would be LESS than the $9,000 they are currently paying and my Grandmother's quality and quantity of care would improve.

Laurel Heights submitted a report stating that each patient gets 4.73 hours of full time care a day.  The rest of the time, they are left alone.  The majority of the time, my Grandmother is cared for by a Certified Nursing Assistant.  At home, she would be cared for by a Licensed Vocational Nurse.  LVN's have higher qualifications and accreditation's than their CNA counterparts.
