Conflict of Interest?

A.  Two parties in the same litigation with the same attorney whose positions are NOT adverse.

 or

B.  A group of attorneys who have created a monopoly in San Francisco's Probate Court.  A group of attorneys that abuse the elderly in San Francisco.  A group of attorneys where one attorney of the group represents the conservator and another attorney in the group represents the conservatee and yet another attorney in the group represents the successor trustee.

So, where is the conflict of interest?

Conservator of the Person - Treatment of Dementia

Taken from the Conservator's Handbook published by the Superior Court of California...

"Treatment of Dementia - A conservator must obtain specific authorization from a judge to give exclusive consent for the treatment of dementia by the use of psychotropic drugs. These may be prescribed by a psychiatrist or by the conservatee's regular physician.   It is important for the conservator to conduct a regular review of this type of treatment, with all the conservatee's doctors, to monitor carefully the effect that such drugs may have on the conservatee."

Forgery, Forgery and One More Forgery

The following three documents were given to Catherine DeMartini's Primary Care Physician on April 27, 2009...Coincidentally, the same day that grandson requested that Doctor declare Catherine DeMartini competent.

All three documents were analyzed by two independent forensic handwriting experts, one of which is the Manager of Forensics for the San Francisco Police Department.  Both experts deemed the documents as...

FORGERIES!

Stroke...

If you thought a 98 year old woman was having a stroke would you....


a.  Have them walk downstairs and transport them to the emergency room in your personal vehicle? 

or

b.  Call an ambulance?

Yet Another Forgery!


On December 29, 2009, Catherine DeMartini's unlicensed caregiver forged Catherine's signature on an application for a permanent disabled person's placard.  The placard was issued under the caregiver's driver's license number.  Do you think she is still using it?  No, that wouldn't be right!

Written by Noni's primary care physician on January 14, 2011...

"I believe that the most humane plan is to consult hospice services to provide comfort care for this elderly woman who can maintain her dignity at home and still enjoy the comfort and familiarity of her home surroundings...."

"Nursing homes bring a substantial amount of anxiety to the demented elderly through a lack of familiarity of surroundings and are not without risk of infection from other patients."


Note that this was written on January 14, 2011.  Why wasn't Noni at home?  Why wasn't hospice brought in until the week of April 11th....three months later?  Why wasn't comfort care started until three months after the doctor recommended it?  Between the time this was written by the doctor and the day my Grandmother died, she was rushed to the hospital two times with pneumonia....infection from other patients?  Did they just want to keep her alive so that they could steal more money from her trust?  Definitely a possibility....don't you think?  They allowed her to suffer in that God awful, sub-standard nursing home and defied her doctor's recommendation.  Unconscionable!

Grandson brings Grandmother to primary care physician who has treated patient for many years.  Primary care physician has previously diagnosed patient with moderate to severe Alzheimer's dementia.

Grandson wants doctor to declare that Grandmother is competent!
