  He died on January 24, 1983...just one month later.  My Grandmother is holding Jamie.

Question: Will a Trust Protect You From Conservatorship?
Answer:  Abosolutely Not!

My Advice to You:  TRUST NO ONE!
                                                                                                                        
My Grandmother created her Trust in 1992 and believed that by doing so she was protecting her loved ones as well as her estate. 

Based on my recent experience, I have learned that a properly constructed estate plan can go a long way in honoring the trustee’s wishes as well as protecting the estate and trust beneficiaries.  Unfortunately, it is not fail safe.

What my Grandmother did not know and what I have painfully discovered is that there are ways to undermine even the best of trust documents.  What I have also learned is that trusts are NOT confidential!

I used to say “that would never happen in my family” but it did.  The last 18 months have been the most painful period of my life.  The brother that I thought was the one person I could trust turned out to be someone I never knew.  Money is definitely the root of all evil.

The following represents just one way a person can undermine an estate plan:

My Grandmother was diagnosed with Alzheimer’s dementia several years ago.  As I stated previously, she had created her Trust in 1992 and had not made any changes to the document.  In 2007 (well after the onset of dementia), she was approached by my Aunt’s estate planning attorney who convinced her that she needed to make changes to her trust in order to reflect current probate code.

This attorney completely changed the intent of my Grandmother’s original trust and even went so far as to make himself the sole trustee, executor and attorney at will.  I discovered his inappropriate, unprofessional behavior when my Grandmother asked me to review the “Amendment” to her estate plan.  The two of us went to his office and confronted him and he supposedly made the Amendment mirror the original trust document except for some minor changes.

It was during this time that I also learned a few things about this attorney.  He not only provides legal services to elderly widows (mostly Italian women whose husbands were either Golden Gate or Sunset scavengers) but he is also a real estate broker, real estate agent, CPA and notary public.  One stop shopping!  This guy does it all!!  I believe that this pathetic excuse for a human being has stolen millions of dollars from the estates of his elderly, unknowing clients. 

Well, not only did this attorney lie to my Grandmother about changing the Amendment to “mirror” her original Trust, he also met with my brother and his sociopath girlfriend and changed my Grandmother’s trust so that brother received everything from the estate except $5000 per year that he was obligated to give my Uncle.  Under my brother’s plan, I received nothing.  He even went to City Hall and altered the deed of trust so that he would own my Grandmother’s house when she passed.  It was ALWAYS my Grandmother’s intention for my Uncle Paul to have the house!

My brother then proceeded to file a legal action against me on July 2, 2009 (my Father’s birthday) that was based on lies, forgeries and fraud.  Since then I have been fighting for my Grandmother, my Uncle, my children, my nephews and myself.

In closing, I have documentation and proof to support EVERY statement that I make in this blog.

Ode to Lizzy Adler

Elizabeth Adler is a professional conservator and fiduciary.  She is also one of two conservators appointed by the court to "protect" my Grandmother.  Ms. Adler recently submitted an invoice in excess of $85,000 for fees related to her job as conservator of my Grandmother's Trust.

Below are my comments in response to an article that I recently read... "Guardian Abuse Rampant in California."  I found the article on the PPG Gazette.

I am currently living a SF Probate Court nightmare, and my heart goes out to Jamie. Thank you for sharing her letter.

In less than two hours, I was able to locate 22 current cases within the probate system in San Francisco that are very similar to both mine and Jamie’s cases. The conservators and their attorneys hang on tight until all the money is gone or the conservatee dies. Families are alienated, the conservatee is isolated, homes are sold, family heirlooms are stolen, lifetime savings are spent on attorney’s fees and other unwarranted expenses that do not benefit the trust or the conservatee.

In my case, there are six attorneys involved. Everytime there is a hearing, the Trust is billed in excess of $7500 just so that the two conservators and their attorneys, the court appointed attorney for the conservatee, a litigator for the conservator and the attorney who fraudulently filed the case to begin with have the opportunity to attend the proceedings, pat each other on the back and pontificate in front of the judge. That $7500 does not include all the time they bill for the motions they file and endless phone calls and emails to each prior to the hearing.

In less than one year, the conservator and the attorney for the conservator, have billed for fees in excess of $100,000. In less than a year, total legal and professional conservator fees being billed to the trust exceed $350,000. The conservator and their attorney want to place a lien on my Grandmother’s house when just one year ago there was nearly $500,000 in liquid assets.

My case was mediated and completely settled in October of 2010. Six weeks later the EXACT same case was filed against me under the SAME case number. It is amazing what these unscrupulous, hypocrits get away with while hiding behind their “court appointed” status.

The sad truth is that my Grandmother is living her last days in a disgusting, God awful nursing home eventhough there is more than enough money to pay for 24 care by a registered nurse in her own home. Living in a nursing home was her worst nightmare. I have begged them to return her to the home she lived in for over 80 years but my requests are ignored. I have been ignored for one year now. Completely shut out of my Grandmother’s life after either seeing her or talking to her EVERY day of my life.

This experience has truly been a nightmare. Forged Trust documents, unlicensed caregivers, changes made to her Trust eventhough the attorney was aware of her incapacity, blatant lies and accusations, the list goes on and on.

There are days I am totally overwhelmed and my thoughts drift to giving up the fight. Luckily, my love for my Grandmother keeps me going and gives me the strength to continue on.

Who Do You See?


Who do you see Herb Thomas, who do you see?

I can no longer talk and have no replies but I certainly know when you tell me your lies.


A sick dying woman who seems not to notice the things that you do
A grandmother who longs to see the family she once knew.

Who, resisting or not, lets you do as you will
Forced to live in a nursing home…I lay here so still.

I'll tell you who I am as I sit here so still,

I'm a small girl of ten with a father and mother,

A brother and sisters, who love one another.



A young girl of sixteen, with wings on her feet,

I’m twenty-five now and have two boys of my own.

But I still have Jamie and Joey and they are my heart.

I think of the years…all too few, gone too fast,
And accept the stark fact that nothing can last.

So open your eyes, Herb Thomas, open and see,
Not a dying old woman; look closer…

Herb Thomas is the "professional" conservator of the person and that person is my Grandmother.  Mr. Thomas recently submitted his invoice for services for the past year.  Over $35,000 for Mr. T and that did not include his attorney's charges for her services!
